Hereinafter referred to as the “Seller”.
And any natural or legal person making a purchase on kitworkshop.com, hereinafter referred to as the “Customer”.
These Terms apply to all sales of products offered on the website, unless specific conditions have been expressly accepted in writing by the Seller.
Article 2 – Purpose
These conditions of sale define the contractual relationship between CLAUDE MICOUD ENTREPRISES and the buyer and the conditions applicable to any purchase made through kitworkshop.com. Purchasing a product through this website implies the buyer’s unreserved acceptance of these conditions of sale, which the buyer acknowledges having read before ordering. Before any transaction, the buyer declares that purchasing products on kitworkshop.com is not directly related to their professional activity and is limited to strictly personal use, and that they have full legal capacity to enter into commitments under these general conditions of sale. CLAUDE MICOUD ENTREPRISES may amend these conditions of sale at any time to comply with new regulations or improve use of its website. Accordingly, the applicable conditions are those in force on the date the buyer orders. Photographs, illustrations and visuals on the website are illustrative. The Seller strives to present products as faithfully as possible.
Article 3 – Products
Each product has a description setting out, where relevant:
- its dimensions
- its materials
- its equipment
- its features
- its conditions of use
- its price
The Customer is invited to read all product characteristics before ordering. Minor differences in colour, grain, texture or appearance resulting from the materials used do not constitute a lack of conformity if they do not affect the product’s essential characteristics. The products offered are those shown on CLAUDE MICOUD ENTREPRISES’ website kitworkshop.com, while stocks last. CLAUDE MICOUD ENTREPRISES reserves the right to change the product range at any time. In general, manufacturing lead times and delivery conditions stated on kitworkshop.com are indicative and may be changed, adapted or updated at any time by CLAUDE MICOUD ENTREPRISES. Products shown on kitworkshop.com are offered for sale to buyers residing in countries that fully permit their entry into their territory. Products shown on kitworkshop.com are offered for sale to buyers residing in the countries exhaustively listed on the website. Orders from outside the listed countries are entirely excluded. CLAUDE MICOUD ENTREPRISES may change the list of countries covered by sales of its products at any time.
Article 4 – Products made to order or to the Customer’s specifications
Some model-making workstations may be made to order or to the Customer’s specific requirements. Requests for special manufacture are assessed individually and quoted separately, with the price determined following the Customer’s acceptance of a quotation. If a product is made to the Customer’s specifications or clearly personalised for them, this will be indicated before the order is confirmed. Under the conditions set out in the French Consumer Code, the right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalised. This exception does not deprive the Customer of the statutory warranties applicable to the product. The Seller may only begin manufacturing a personalised product once all characteristics necessary for its manufacture have been approved.
Article 5 – Prices
Prices displayed on the website are in euros and include all taxes, taking account of the VAT applicable on the order date, unless stated otherwise. Any change in the VAT rate may be reflected in product prices.
The applicable price is the price displayed on the website when the order is confirmed.
Delivery charges are shown separately before the order is finally confirmed.
The total amount payable, including the price of the product or products and any delivery charges, is presented to the Customer before the order is confirmed.
The Seller reserves the right to change its prices at any time. Such changes do not apply to orders already confirmed.
Any price reductions are indicated in accordance with applicable regulations.
Article 6 – Orders
Before ordering, the buyer must create an account on kitworkshop.com. Account registration is accessible directly from the side menu bar. On each visit, buyers wishing to place an order or view their account (order status, profile, etc.) must sign in using these details.
The Customer selects the products to order and adds them to the basket, makes any necessary changes (quantity, references, etc.) and checks the delivery address or enters a new one. Delivery charges are then calculated and presented to the buyer. The buyer then selects their preferred payment method. Finally, they are invited to check all information, read and accept these general conditions of sale by ticking the corresponding box, and confirm the order by clicking the “confirm order” button. This final click definitively concludes the contract.
An order confirmation email is sent to the Customer at the address provided when ordering.
The Seller reserves the right to refuse an order on legitimate grounds, including an unusual request, a difficulty relating to the order or information that is manifestly incorrect.
Article 7 – Availability and manufacture
Available products are dispatched within the timeframe stated on kitworkshop.com. Products made specifically to order are subject to a manufacturing lead time stated when ordering.
If exceptional difficulties are likely to cause a significant delay, the Customer is informed as soon as possible.
The stated timeframes are communicated before the sale is concluded.
Article 8 – Payment
Payment is made using the methods offered on kitworkshop.com at the time of ordering.
Depending on the products and terms offered, the Customer may in particular have access to the following payment methods:
- Paypal
- payment card
- split payments or payment in instalments, where offered
- payment in full
PayPal payments are made through PayPal’s secure interface.
Card payments are processed through a secure payment service provider.
Where payment in instalments is offered by a specialised provider, the specific terms of that payment are presented to the Customer before confirmation.
The Seller does not retain the Customer’s full card details.
After confirming the order, the buyer is redirected to the interface of the chosen payment method to enter account details securely. If payment is accepted, the order is recorded and the contract definitively concluded. Payment by PayPal account, card or instalments is irrevocable. In the event of fraudulent use of a payment method, the buyer may demand cancellation of the payment; amounts paid will then be recredited or refunded. The cardholder is not liable if the disputed payment is proven to have been made fraudulently, remotely and without physical use of the card. To obtain reimbursement of the fraudulent debit and any resulting bank charges, the cardholder must dispute the debit in writing with their bank within 70 days of the transaction, or 120 days if their agreement with the bank provides for this. The bank refunds the debited amounts within one month at most after receiving the cardholder’s written dispute. No refund fee may be charged to the cardholder.
Confirming an order entails acceptance of these conditions of sale, acknowledgement of full familiarity with them and waiver of the buyer’s own purchasing conditions. All information supplied and the recorded confirmation constitute proof of the transaction. If the buyer has provided an email address on the order form, CLAUDE MICOUD ENTREPRISES will email confirmation that the order has been recorded.
To contact CLAUDE MICOUD ENTREPRISES, the buyer may write to SARL CLAUDE MICOUD ENTREPRISES, 765 route du Grésivaudan 26750 PARNANS (FRANCE), or email entreprise.micoud@orange.fr.
Article 9 – Non-payment
If payment is refused, unpaid or the financing needed to fulfil the order is cancelled, the Seller may suspend dispatch or manufacture until the situation is resolved, within the limits of applicable regulations.
For personalised or made-to-measure orders, the Seller may suspend manufacture until the required payment or financing approval is received.
Article 10 – Retention of title
CLAUDE MICOUD ENTREPRISES retains full ownership of the products sold until the price has been received in full, including the principal amount, charges and taxes.
Article 11 – Delivery
Products are delivered to the address given by the Customer when ordering, which must be within the agreed geographical area. Delivery arrangements and charges are stated before final confirmation of the order. Depending on weight and dimensions, complete workstations may be shipped on several pallets. Spare parts and accessories may be shipped separately in suitable packaging. For delivery of products ordered by the buyer, CLAUDE MICOUD ENTREPRISES reserves the right to choose the appropriate transport method and the carrier responsible for delivery. The Customer must check that the delivery address is correct before confirming the order. Any address error supplied by the Customer that necessitates another delivery may result in additional costs actually incurred being charged. The carrier delivers to the buyer’s home. Transport risks are borne by the buyer from the moment the items leave CLAUDE MICOUD ENTREPRISES’ premises. The buyer must check the condition of the packaging and its contents upon delivery in the driver’s presence. Any complaint regarding damage during transport must be made to the carrier within three days of delivery.
Article 12 – Receipt of products
On delivery, the Customer is invited to check the visible condition of the package, pallet and product.
In the event of visible damage, the Customer must, where possible, record specific reservations with the carrier and retain the packaging and any evidence of the damage.
The Customer must also promptly inform the Seller of any problem identified.
These steps are intended in particular to facilitate handling of the claim with the carrier.
They do not in any way deprive the consumer of their statutory warranty rights.
Article 13 – Transfer of risk
In accordance with the provisions applicable to sales to consumers, the risk of loss or damage to the product passes to the Customer when the Customer, or a third party designated by them other than the carrier proposed by the Seller, takes physical possession of the product.
Article 14 – Right of withdrawal
Under Article L121-20 of the French Consumer Code and the regulations applicable to distance contracts, consumers generally have fourteen (14) days to exercise their right of withdrawal, without giving a reason or incurring any penalty other than costs provided for by the regulations.
For goods, the period begins when the Customer or a third party designated by them receives the product.
Where an order covers several products delivered separately, the period begins on receipt of the last product.
The Customer may exercise the right of withdrawal by sending the Seller an unambiguous statement expressing their decision to withdraw.
The Customer may also use the withdrawal form annexed to these Terms.
The product must be returned as follows: it must be dispatched to CLAUDE MICOUD ENTREPRISES, 765 route du Grésivaudan 26750 PARNANS (FRANCE), in its original packaging and entrusted to a carrier. The buyer must pay the return costs and may not claim reimbursement of them from CLAUDE MICOUD ENTREPRISES.
The Customer must take reasonable care of the product during the period before any return.
The Seller refunds the amounts due in accordance with applicable regulations and subject to the conditions they provide.
The refund may be withheld until the product is recovered or the Customer provides proof of dispatch, whichever occurs first.
Article 15 – Exceptions to the right of withdrawal
The right of withdrawal does not apply, in particular, to goods made to the consumer’s specifications or clearly personalised, where the legal conditions for this exception are met.
This exception may in particular cover a workbench made specifically to dimensions, configurations or characteristics requested by the Customer.
However, it may only be invoked where the legal conditions allowing this exclusion are actually met.
The Seller will clearly indicate before the order if a product is covered by this exception.
Article 16 – Statutory warranties
The Seller is bound by the legal guarantees applicable to the products sold to the Consumer Client, and in particular the legal guarantee of conformity and the legal guarantee of hidden defects.
These warranties apply independently of any commercial warranty that the Seller may offer.
1. Legal guarantee of conformity
In accordance with articles L.217-3 et seq. of the Consumer Code, the Seller is liable for any defects in conformity that exist at the time of delivery of the goods and that become apparent within two (2) years from that time.
The statutory guarantee of conformity applies in particular where the product:
does not conform to the description, characteristics or qualities stated by the Seller; is not fit for the use normally expected of goods of the same type;
does not match the characteristics agreed with the Customer; has a manufacturing defect, imperfection or malfunction making it unfit for its normally expected use.
For products including components or accessories necessary for their operation, the warranty also applies, under the conditions laid down by law, to defects arising in particular from packaging, assembly instructions or installation where installation is the Seller’s responsibility or where incorrect installation results from omissions or errors in the instructions provided by the Seller. The consumer Customer may request that the product be brought into conformity, choosing between repair and replacement, subject to the conditions laid down by law, particularly where one of these solutions is impossible or entails disproportionate costs for the Seller.
The compliance process takes place within a reasonable timeframe that cannot exceed thirty (30) days following the Client’s request, and without causing any significant inconvenience to the Client. It is carried out free of charge for the Client, in accordance with applicable legal provisions.
Where necessary, repair or replacement includes removal and collection of the non-conforming product as well as delivery and installation of the repaired or replacement product under the conditions provided for by law.
Where bringing the product into conformity is not possible under the statutory conditions, where the Seller refuses to do so, where it takes longer than the statutory period of thirty (30) days, where it causes major inconvenience to the Customer or where the lack of conformity persists despite an attempt to remedy it, the Customer may, under the conditions laid down in Articles L.217-14 et seq. of the French Consumer Code, obtain a price reduction or termination of the contract.
However, the resolution of the contract cannot be requested when the lack of conformity is minor, under the conditions provided by law.
When a product is repaired under the statutory guarantee of conformity, that guarantee is extended by six (6) months.
Where the Customer has chosen repair but the Seller does not carry it out, replacement of the product starts a new statutory conformity guarantee period for the replacement product, under the conditions provided for by law.
The statutory guarantee of conformity applies without prejudice to the statutory warranty against hidden defects under Articles 1641 to 1649 of the French Civil Code.
2. Legal guarantee against hidden defects
Under Articles 1641 et seq. of the French Civil Code, the Seller is liable for hidden defects in the product sold that render it unfit for its intended use or impair that use to such an extent that the Customer would not have purchased it, or would only have paid a lower price, had they known of them.
The defect must be hidden, predate the sale and be sufficiently serious to make the product unfit for its intended use or substantially reduce that use.
The Seller is not liable for visible defects that the Customer could have identified personally at the time of sale.
If a hidden defect is established, the Customer may, under the conditions of Article 1644 of the French Civil Code:
return the product and obtain a refund of the price paid; or keep the product and obtain a partial refund.
If the Seller knew of the defect at the time of sale, Article 1645 of the French Civil Code may also entitle the Customer to damages. The Customer must bring any action based on hidden defects within two (2) years of discovering the defect, in accordance with Article 1648 of the French Civil Code.
3. Exclusions from legal guarantees
Legal guarantees do not cover defects resulting from, among other things:
use of the product contrary to its intended purpose;
failure to follow the assembly, use or maintenance instructions provided by the Seller, where that failure caused the defect;
a modification or alteration made to the product by the Customer or a third party without the Seller’s agreement; abnormal or inappropriate use of the product;
damage resulting from an accident, impact, fall or negligent use;
normal wear and tear of the product or its components;
damage resulting from unsuitable maintenance or the use of inappropriate products or accessories where these caused the damage.
However, these exclusions cannot deprive the consumer Customer of statutory warranty rights where those warranties are legally applicable.
4. Implementation of safeguards
Any claim under a statutory warranty must be sent to the Seller in writing, stating in particular:
the order number or relevant invoice; the purchase date;
the reference of the product concerned; ;
a precise description of the defect found; and, where useful, photographs or other evidence demonstrating the defect.
The request may be sent to: CLAUDE MICOUD ENTEPRISES 765 ROUTE DU GRESIVAUDAN 26750 PARNANS entreprise.micoud@orange.fr Upon receiving the request, the Seller may ask the Customer for any information needed to examine the defect and will determine, in accordance with the applicable law, the arrangements for repair, replacement, price reduction or termination of the contract.
Where necessary, the Customer must allow the Seller to examine the product concerned and carry out repairs, collection or replacement under the conditions provided for by law.
These provisions do not deprive the consumer customer of the rights they enjoy under the mandatory provisions of the Consumer Code and the Civil Code.
5. Reminder of legal provisions
The consumer Customer is informed that they benefit from:
the statutory guarantee of conformity under Articles L.217-3 et seq. of the French Consumer Code; the statutory warranty against hidden defects under Articles 1641 to 1649 of the French Civil Code.
These statutory warranties are independent of any commercial warranty granted by the Seller. Applicable legal provisions prevail over any provision of these Terms that is less favourable to the consumer Customer.
Article 17 – Commercial warranty
Where the Seller offers an additional commercial warranty, its conditions and duration are specified in the product description, contract or warranty document provided to the Customer.
This commercial warranty neither limits nor replaces the statutory warranties available to the consumer.
Article 18 – After-sales service
For any enquiry about an order, an operating problem or after-sales service, the Customer may contact:
CLAUDE MICOUD ENTEPRISES Address: 765 route du Grésivaudan 26750 PARNANS (FRANCE) Email: kitworkshop26@gmail.com

Article 19 – Use of products
The workbenches and equipment sold are intended to be used in accordance with their description and intended purpose. The Customer must comply with any assembly, installation and operating instructions supplied with the product. The Seller cannot be held liable for damage resulting from use contrary to the instructions provided, unauthorized modification of the product or use for a purpose other than its intended purpose, subject to applicable mandatory legal provisions.
Article 20 – Assembly and installation
Where the product is delivered as a kit or partially disassembled, any assembly instructions are supplied as indicated on the website. Unless expressly stated otherwise in the order, delivery of a product does not include installation at the Customer’s premises. Where the Seller offers an installation or assembly service, the terms and price of that service are specified before the order is placed.

However, the Seller’s liability may not be limited or excluded where such a limitation is prohibited by applicable regulations.
The Seller cannot be held liable for damage resulting from an event of force majeure within the meaning of applicable regulations.
